Definitions
In these terms and conditions the following words have the following meanings:
‘We’, ‘us’, ‘our’, ‘RSVIP Card’ ‘RSViP’
Are terms used to refer to the originators, owners and operators of RSVIP Card.
‘You’, ‘your’ ‘RSViP’s’
RSVIP Cardholders/members
’Guestlist’
Social gatherings, parties, launches and events advertised by us via the website
‘Website’
The website operated by us known aswww.rsvipcard.co.uk
‘Membership card’
The membership card we give you upon registration with RSVIP Card
‘Participating Establishments’, Affiliated Establishments’
Any company/business/establishment with whom we agree a discount or special offer for you as part of the service.
‘Entourage’
A range of services recommended by RSViP to you the members offering various discounts & special rates
‘Service’
The discount service/offers and exclusive ‘Guestlist’ access service provided by us as detailed on the website.
BY USING THE SERVICE YOU ARE AGREEING TO ALL OF THE TERMS AND CONDITIONS CONTAINED IN THE AGREEMENTS.
1 General
1.1 These terms and conditions are the only conditions under which we are willing to provide the service to you. These conditions can only be modified as set out in these conditions or by variation in writing signed by a director of RSVIP Card.
1.2 We reserve the right to amend or vary these terms and conditions at any time. We will give notice of any such variation or update.
1.3. Nothing in these terms and conditions shall detract from your rights as a consumer.
1.4. These terms and conditions (including any documents referred to within them) Contain all the terms on which we provide the service to you. They supersede any prior promises, representations (except fraudulent representations), undertaking or implications made.
1.5 These terms and conditions do not create any right enforceable by a person not a party to them.
2 Membership
2.1 Membership is by application only and is renewable annually.
The products and services provided by rsvip may only be used by individual persons and not on behalf of any commercial entity unless specifically permitted by rsvip
2.2 We will not be able to accept your application without complete and accurate information required by us and provided by yourself.
2.3 Membership of the service is only available to persons over the age of eighteen (18) and a permanent resident of the United Kingdom.
By entering the site you are agreeing that you are over the age of eighteen(18) and are a permanent resident of the United Kingdom.
2.4 The RSViP website is for the personal use of those who are at the legal age to purchase and consume alcoholic beverages on site within a licensed premises
2.5 The membership card will entitle you as the cardholder to access and utilise a range of discounts at participating establishments and service providers, in addition to exclusive access to information on events within the ‘Guestlist’ section of the website.
2.6 The membership card remains the property of RSVIP Card at all times and we reserve the right to discontinue your membership if you do not abide these by terms and conditions.
2.7 The membership card is personal to you. You must not lend or give the card to any other person. Breach of this clause will entitle us to terminate our agreement with you.
2.8 The membership is renewable after one (1) year and you will be notified in advance as to when you need to renew your membership.
2.9 A new membership card will be sent to you upon renewal on a yearly basis if you so choose to renew and you must destroy obsolete membership cards in accordance with our instructions.
2.10 You will be charged a replacement fee of £30 for a lost, misplaced, stolen or confiscated membership card, however for repeated requests for replacement cards, rsvip reserve the right to discontinue membership
2.11 Abuse of membership by card-sharing is strictly forbidden and rsvip and its affiliated establishments reserve the right to confiscate cards if this is suspected.
3 Discounts
3.1 It is your responsibility to access the members area- known as the Guestlist for information on forthcoming events and not rely on us to inform you directly via email or any other form of communication.
3.2 It is your responsibility to rsvp to the events you wish to attend and abide by the relevant rules written on the website for example dress code.
3.3 We do not have any control over goods/products or services provided by participating establishments. If you have any complaints or queries these should be raised with the participating establishment directly. However RSVIP Card values any feedback both positive and negative so that we can monitor our participating establishments in order to provide the best service possible to our members.
3.4 Discounts are at the discretion of our participating establishments And are subject to change however we will endeavour to keep you updated as to their current discount offering as and when appropriate the amended discount/offer
3.5 It is the members responsibility to check on the RSVIP website for the relevant and latest discounts/offers associated with RSVIP card prior to attending the affiliated establishment
3.6 you MUST present your RSVIP card before you make a purchase at a participating establishment or prior to attending an event or entering an establishment offering exclusive entry to cardholders/members in order to take advantage of the offers/discounts that may be available to you as an RSViP member
3.7 RSViP card is not responsible if a participating establishment changes its discount due to new ownership/management or acquisition.
3.8 You may report disputes with participating establishments by contacting RSVIP card. Reports must be submitted by email with the following information: Establishment name, date and approx time of dispute, discount denied and any other relevant information to info@rsvipcard.co.uk
3.9 Offers made available through RSVIP card may change from time to time. RSVIP card reserve the right to change any offer and/or affiliated establishments at any time. In addition affiliated establishments may elect to change their offers from time to time. RSVIP card will make commercially reasonable efforts to make appropriate updates to the website as and when it is necessary. For a listing of current discounts/offers and events cardholders should visit www.rsvipcard.co.uk. If you become aware of a discontinued offer listed, please notify RSVIP card by emailing info@rsvipcard.co.uk
3.10 RSVIP card undertakes no obligation to provide a replacement or substitute offer for any offer discontinued.
3.11 Only the authorised signatory can use the RSVIP card and be eligible for its offers and discounts.
4 Code of Conduct
4.1 You should not commit any act of unruly behaviour at any event or affiliated establishment we promote. Unruly behaviour is any unreasonable conflict or actions both verbal and physical that result in an unnecessary situation between yourself, the affiliated establishment or anyone present and that we deem to be unruly in our reasonable opinion.
5 PAYMENT AND CANCELLATIONS
Please pay particular attention to the following information for your own understanding and benefit:
5.1 You acknowledge that all subscriptions are subject to a non-refundable fee.
5.2 A twelve (12) monthly contract applies to all memberships.
5.3 You agree to pay an up front one-off payment in full via the website. you will therefore have to contact us to make payment in the second year and subsequent years thereafter to re new your membership and make payment in full.
5.4 in exceptional circumstances and at our own discretion Should rsvip make any refunds, these will be done using the method used in the original transaction and to the person names on the membership card only. rsvip will not issue refunds by cash, cheque or to anyone other than the person named on the membership card
6 Lost cards
In the event that you lose your rsvip membership card you will be charged a replacement fee of £50 and your replacement card will mirror the original renewal date.
7Software
7.1You must not attempt to upload files without specific permission from rsvip including that which contain viruses, corrupted files, promotion of illegal activities such as abuse, harassment, or acts of cruelty to both humans and animals or files including video and audio dialogue.
7.2You agree that any material or data which is downloaded or obtained by using the services providing by rsvip is at your own risk and we take no responsibility for damage or loss of data to your computer as a result of such actions
8. Termination
8.1 Your card and membership will automatically expire exactly one (1) year from date of issue in a month/year format. therefore resulting in deactivation of your access to the ‘guestlist’ section of the website
8.2 RSVIP card can terminate this agreement at any time on giving notice to you if you breach the terms and conditions of this agreement.
8.3 We reserve the right to terminate your agreement at any time and for any reason on giving one months notice to you.
8.4 On termination of your agreement for any reason you:
8.4.1 must return your membership card to us
8.4.2 you will no longer be able to benefit from the service or access the ‘Guestlist’ section of the website.
9.Privacy
9.1 We will request certain personal information from you in order to process and issue you with membership. You are responsible for the accuracy and truthfulness of this information and by submitting your personal details warrants this to be true and accurate and we will take it as so.
9.2 We will use you personal information solely for the purposes of providing the service to you. We will treat your personal details as confidential and we will not disclose it to any third party except:
9.2.1 as required by law or;
9.2.2 to any successor to or purchaser of the business and assets of RSVIP card should this become necessary.
9.3 Rsvip reserves the right to inform you of products, services, updates and other related services by email.
10. Copyright
10.1 All material on the website known as www.rsvipcard.co.uk is the copyright of RSVIP card and you should assume that all content featured on the website is copywrited unless otherwise stated and may not be used unless written permission is granted. The copying or adaptation of the material on this website or its incorporation into any other work by any means is prohibited, except that you may download or print extracts of such material for your non-commercial and PERSONAL use. You are not granted any other rights in respect of copyrighted material. This applies to promotional material also. the misuse of any logos, images or any other content on the website, except as provided in these terms and conditions is strictly prohibited. You should be made aware that RSViP will enforce its intellectual property rights to the fullest extent of the law, including the seeking of legal action if necessary.
11 Website
11.1 The RSVIP website offers the most up to date information on discounts at participating establishments. We make reasonable efforts to maintain the currency of the discounts provided by our participating establishments. However we are not responsible for third parties restrictions or changes to their offers not communicated to RSVIP card.
11.2 RSVIP card may provide access via hypertext links to resources on other websites. In doing so we are not endorsing any linked entities nor authorising any act which may be in breach of copyright or any other third party rights which are protected in law or by international treaties worldwide. We do not accept any responsibility or liability for any of the material contained on a third party site.
12 Liability and disclaimer
12.1 We use reasonable care to make sure all of the information appearing on the website is accurate and up to date. However we shall not be liable for any loss, damage, expense incurred by you as a result of any error or omissions by us or any third party.
12.2 The website is provided ‘as is’ and we do not have control over the use that may be made of the information provided on it. Accordingly we exclude (to the fullest extent permitted by law) all warranties, express or implied, as to the quality, accuracy, timeliness, completeness, performance or fitness for a particular purpose of the website, any of its contents or the service in general. In particular we make no warranty or representation that the service will meet your requirements or meet your expectations or that the operation of the website will be uninterrupted, timely, secure or error free.
12.3 We do not accept liability for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damage for loss of profits, anticipated savings, goodwill, use, data or other intangible losses( even if we have been advised of the possibility of such damages) including but not limited to anything resulting from the use of or inability to use the website and/or service.
12.4 We will not be liable if we are unable to perform our obligations under these terms and conditions due to the failure of any machine equipment, data processing system or transmission link or to any circumstances beyond our control ( including but not limited to strike, industrial action, war, acts of terrorism, fire, act of God or accident of any kind).
12.5 If we are found liable to you our liability shall not exceed the total price paid by you to us for the service.
12.6 You agree that given the nature of the service, exclusions and limitations of our liability are reasonable.
13 Ownership
13.1 All contents of the website are directly in connection with the service provided by rsvip and all participating establishments advertised on the website have pre negotiated and agreed their exclusive offer/discount with rsvip in writing.
13.2 Participating establishments have the right to amend or withdraw their offer at anytime by notifying rsvip in writing.
13.3 Once written notification has been received rsvip have 30 days in which to withdraw the information from the website
13.4 Participating establishments agree to honour the agreed discount/offer advertised on the website for as long as they have presence on the website and are obliged to notify rsvip as soon as there are any changes which may affect the running of rsvip services
14 CONTENT
14.1 All of the special offers/discounts featured on the rsvip website are described as accurately as possible however rsvip does not warrant that descriptions are fully accurate, or error-free.
The content of the rsvip website is appropriate only for use within the united kingdom, however those who choose to access the website from outside the united Kingdom do so at their own discretion and are responsible for compliance with English law.

15 Law
15.1 These terms and conditions are subject to English law and you and we submit to the exclusive jurisdiction of the English courts.
